These Terms of Service ("Terms") are a contract between you and Venturi Sports LLC ("Venturi," "we," "our," or "us"). They govern your use of the Venturi mobile app, the Venturi Apple Watch app, venturisports.com, and everything we offer through them (together, the "Platform").
By creating an account, or by using the Platform at all, you accept these Terms. If you do not accept them, do not use the Platform.
Two related documents form part of this agreement. Our Privacy Policy explains what we collect and why. Our Marketplace Terms govern lessons, guided rides, rentals and gear sales, and control over these Terms wherever the two conflict on a marketplace matter.
You must be at least 13 to hold a Venturi account. If you are under 18, you may use the Platform only with the involvement of a parent or guardian who accepts these Terms on your behalf.
You must be at least 18 to host — to offer lessons, guided rides or rentals, or to sell gear. Hosting is governed by the Marketplace Terms in addition to these.
You may not use the Platform if we have previously terminated your account, or where the law prohibits it.
You can sign in with an email sign-in link, with Google, or with Apple. You are responsible for keeping access to that email address and those accounts secure, and for everything that happens under your account.
Give us accurate information and keep it current. One person, one account. Do not share your account, impersonate anyone, or create an account on someone else's behalf without their authority. Tell us promptly if you believe your account has been compromised.
Venturi is a platform for foiling, kiting, winging, surfing and related watersports. Depending on your plan and your device, it offers:
We may add, change, suspend or remove any part of the Platform at any time. Some features depend on your device, your operating system, your permissions, and third parties outside our control.
Read this section carefully. It is the most important one here.
Foiling, kiting, winging, surfing and related watersports are inherently dangerous. They carry a real risk of serious injury, drowning and death — to you, and to others in the water — from equipment failure, collision, sharp foils, surf, current, marine life, weather and human error. You understand these risks and voluntarily assume them. You are responsible for your own decision to enter the water, every time.
All forecast, wind, wave, tide, current, buoy, camera and map data on the Platform is information only. It comes from third-party models and sensors, it is frequently wrong, it can be stale or missing entirely, and it is never a substitute for your own on-site judgement. We do not warrant that any of it is accurate, current or complete. Never rely on it as your sole basis for deciding whether conditions are safe.
Nothing on the Platform is instruction, coaching, certification, medical advice or a safety assessment. Health metrics such as heart rate come from your device and are not medical-grade. Venturi does not supervise anyone's activity and cannot call a session off for you.
You are responsible for your own equipment, your own skill level, your own physical fitness, obeying local rules and access restrictions, and having whatever permits, licences and insurance your activity requires.
Parts of the Platform require a paid Venturi subscription. Free accounts get a shorter forecast horizon and do not get live cameras, live buoys, Strava sync, advanced session statistics or personalised recommendations. What is included in each tier can change.
Subscriptions are sold and billed through the Apple App Store or Google Play, managed on our side by RevenueCat. Payment is charged to your store account at confirmation of purchase.
Subscriptions renew automatically. Your subscription renews at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. Your store account is charged for renewal within 24 hours of the end of the current period.
Manage or cancel your subscription in your Apple App Store or Google Play account settings. Cancelling stops future renewals; it does not refund the current period. Deleting the app does not cancel your subscription.
Refunds are handled by Apple or Google under their own policies, not by us. Where a free trial is offered, any unused portion is forfeited when you buy a subscription. We may change subscription pricing; a change takes effect at your next renewal, and where the law requires it we will give you notice and the chance to cancel first.
Lessons, guided rides, rentals and gear sales are governed by our Marketplace Terms, which apply to hosts and riders both.
In short: Venturi is a venue where riders find hosts. When you book, the contract for that lesson, ride, rental or sale is between you and the other person. Venturi is not a party to it, does not verify what hosts say about themselves, does not inspect gear, and does not screen or background-check anyone unless we expressly say otherwise. Payments are processed by Stripe.
"Your content" means everything you upload or post: photos, video, session and route data, posts, comments, reviews, messages, listings, gear entries and profile information.
You keep ownership of it. You grant Venturi a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, adapt, publish, translate, display and distribute your content for the purposes of operating, promoting and improving the Platform. That licence ends when you delete the content, except to the extent we have already used it in marketing, it has been shared with others who retain a copy, or copies persist in backups.
You warrant that you own or are licensed to use everything you upload, and that it infringes nobody's rights. If a person is identifiable in a photo or video you upload you must have their permission — and for a minor, their parent's or guardian's.
Some of your content is public by default, including your rider profile and sessions shared to spot pages. You can make your sessions private in the app's profile settings. Assume that anything you post publicly may be seen, saved and re-shared by anyone.
We may remove or restrict any content, at any time, for any reason — including content that breaks these Terms, that we believe is unsafe, unlawful or harmful, or that we are required to remove. We are not obliged to monitor content, and we do not undertake to.
You will not:
Direct messages and group chats are private between participants, but they are not end-to-end encrypted. We can access message content where we need to — to operate the service, to investigate a safety report or abuse, or to comply with the law.
Presence and live-tracking features share your location with the people you choose. Think about who can see you before you turn them on, and turn them off when you do not want to be visible.
The Platform connects to services we do not control, including Apple Health, Garmin, Strava, Stripe, Apple and Google billing, Mapbox, and the weather, buoy and camera providers behind our conditions data.
When you connect one, you authorise us to exchange data with it as described in our Privacy Policy, and your use of it remains governed by that provider's own terms. We are not responsible for third-party services, for their data, or for their acts or omissions. You can disconnect an integration at any time from the app or from the provider.
Some features generate text with AI — conditions narratives and session reports among them. AI output is generated automatically, is not reviewed by a person, and can be wrong, incomplete or misleading. Treat it as informational only. Never use it as a basis for a safety decision, and never treat it as instruction, medical or professional advice.
The Platform, and everything in it other than your content and third-party content — including the software, design, text, graphics, the Venturi name and logo, and our compilation of spot and conditions data — belongs to Venturi or our licensors and is protected by intellectual property law.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Platform for your own non-commercial use, and for hosting where the Marketplace Terms allow it. We reserve every right not expressly granted.
If you send us feedback, ideas or suggestions, we may use them freely and without obligation or compensation to you.
If you believe content on the Platform infringes your copyright, email app@venturisports.com with a description of the work, where the material is on the Platform, your contact details, and a statement that you have a good-faith belief the use is unauthorised and that your notice is accurate. We may remove content and terminate repeat infringers.
You may stop using the Platform at any time, and you can delete your account from the app or by submitting a deletion request.
We may suspend or terminate your access at any time, with or without notice, including where we believe you have broken these Terms, where someone has raised a credible safety concern, or where the law requires it.
On termination your licence to use the Platform ends. Confirmed bookings are handled under the Marketplace Terms. Deleting your account does not end a subscription bought through Apple or Google — cancel that in your store account. The sections on your content licence, acceptable use, assumption of risk, disclaimers, limitation of liability, indemnification and governing law survive.
The Platform is provided "as is" and "as available". To the fullest extent permitted by law, Venturi disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the Platform will be uninterrupted, secure, error-free or free of data loss, that forecast, tide, buoy, camera or map data will be accurate, that session tracking will capture your session correctly or at all, or that any user is who they say they are.
Background GPS tracking depends on your device, its battery, its permissions and its operating system, all of which can stop a recording without telling us or you. Keep your own record of anything you cannot afford to lose.
To the fullest extent permitted by law, Venturi will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to these Terms or the Platform.
To the fullest extent permitted by law, Venturi's total aggregate liability arising out of or relating to these Terms or the Platform will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or US$100.
Nothing here excludes liability that cannot lawfully be excluded, including for our own fraud, gross negligence or wilful misconduct, or for death or personal injury caused by our negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
You will indemnify, defend and hold harmless Venturi, its affiliates and their officers, directors, employees and agents from any claim, loss, liability, damage, penalty or expense (including reasonable legal fees) arising out of or relating to: your use of the Platform; your content; your breach of these Terms or of any law or third-party right; your activity in the water and any injury, death or property damage connected to it; and any dispute between you and another user.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, and you consent to venue there.
Before filing anything, you agree to contact us and try to resolve the dispute informally for 30 days.
You acknowledge that these Terms are between you and Venturi, not with Apple or Google. Apple and Google are not responsible for the app or its content, and have no obligation to provide support or to handle any claim relating to it. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
We may change these Terms. We will post the updated version here and update the date above, and where a change is material we will give you reasonable notice in the app or by email. Continuing to use the Platform after a change takes effect means you accept it.
If any provision is unenforceable the rest stands. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger or sale. These Terms, the Privacy Policy and the Marketplace Terms are the entire agreement between us about the Platform.
